Terms and Conditions
Welcome to the websites and online services owned, operated or provided by the Conseil des arts de Montréal (“CAM” or “us”). These Terms and Conditions govern your use of all websites, applications, and other online services offered by the CAM (the “Services”). This document was updated on June 20, 2022.
Terms of Use
By using our online services, you agree to abide by these terms and conditions. Please note that we may occasionally modify our Terms and Conditions. It is therefore important to review them regularly. We will notify you of any changes by posting a revised version of the Terms and Conditions on our Services. Continued use of the Services after the revised Terms and Conditions have been posted will be interpreted as acceptance of these Terms.
Other Terms and Conditions
Other than those described in these Terms and Conditions, other terms and conditions may apply to your use of our Services. We will provide you with these other terms or post them on the Services to which they apply. In the event of any discrepancy between these Terms and Conditions and additional terms and conditions applicable to a particular service, the additional terms and conditions will prevail.
Reservation Procedures
Some of our Services allow you to make online reservations, for example, to participate in CAM-organized events or to book a studio at the Maison du Conseil. Booking terms for these Services are indicated on the sites of the relevant Services or on the sites of our service providers.
If we believe that your reservation is in violation of any law or any of our Terms and Conditions, we reserve the right to cancel your reservation.
Payment Terms
Some of our Services enable online payments, such as for renting a studio at the Maison du Conseil or making an online donation. The payment terms applicable to these Services are indicated on the sites of the relevant Services or the sites of our service providers. When you provide us with your payment information, you authorize us to charge the amount due to the payment method selected from among those offered, and you represent and warrant that you are authorized to use the selected payment method.
If we believe that your payment violates any law or any of our terms and Conditions, we reserve the right to cancel your transaction.
Voting and Survey Procedures
Some of our Services offer you the opportunity to express your opinion through voting and survey mechanisms. Terms and conditions specific to these Services are listed on the sites of the relevant Services or the sites of our service providers.
If we believe that your participation in a vote or survey violates any law or any of our Terms and Conditions, we reserve the right to cancel your participation.
Email and Other Electronic Messages
From time to time, we may send you newsletters and other promotional emails or electronic messages. You can unsubscribe from these promotional emails through the unsubscribe mechanism contained in any message.
Please note that we may also send you transactional or operational messages in connection with your use of one of our Services. These messages are sent to you automatically. Their purpose is to confirm the operation or transaction you have just completed through one of our Services (e.g., booking a studio). In most cases, you cannot unsubscribe from this type of email unless you stop using our Services. To verify your available options, or limit or suspend these messages, contact CAM at artsmontreal@montreal.ca.
Registration and Login Information
We may ask you to register to access or use some of our Services, and you may need to log in to access these Services later. From time to time, we may ask you to reset or update your password or profile information. We may also ask you to provide us with additional information when registering or logging into one of our Services. This information is requested for various reasons, including to reset your password, verify your eligibility for one of our Services, or make a payment. You agree to provide us with accurate and complete information and to update it as it changes.
Please note that you have the right to refuse to provide us with information. However, in most cases, this information is required when creating your account or using our Services. Account Maintenance and Security
Your username and password are your access codes. They are confidential. You accept responsibility for keeping them safe, and for all accesses to our Services made through your account.
In addition, you agree to take all reasonable steps to prevent the loss, disclosure, modification, or unauthorized use of your access codes. If you suspect or become aware that unauthorized collection, use, disclosure, or destruction of information associated with your account has occurred, you agree to notify us immediately. Notifications in this regard must be sent to the following email address: artsmontreal@montreal.ca.
Account Suspension and Cancellation
We reserve the right to suspend or terminate your account if you fail to comply with these Terms and Conditions or other terms of access to our Services. Your account may be suspended or terminated by our service providers. The CAM will attempt to notify you of any suspension or cancellation of your account. However, in certain circumstances, the CAM or its service providers may suspend or terminate your account without notice.
User Content
You are responsible for all content (comments, photographs, audio-video recordings, and other content, etc.) that you submit to us through our various Services, including our social media accounts. For example, it is your responsibility to ensure that you are not sending content that could:
- be recognized as false, inaccurate, or misleading;
- infringe the copyright, patent, trademark, trade secret, or property rights of a third party, or any other right of publicity or privacy;
- violate any law, act, order, or regulation;
- be or appear to be inaccurate, abusive, vulgar, indecent, defamatory, hateful, religiously tendentious or offensive, threatening or harassing toward any person, company, or partnership;
- be considered advertising, junk mail, spam, chain letters, or any other form of solicitation;
- contain a virus or worm, or any other potentially damaging computer program or file.
We may refuse or remove the shared content if it violates these Terms and Conditions. However, this does not mean that we are required to monitor user content on our Services. In other words, you agree that we are not responsible for this content or for any loss or damage resulting therefrom.
Acceptable Use of our Services
You agree not to use our Services for any unlawful purpose or for any other purpose prohibited by this clause. You agree not to use our Services for the following purposes:
- harass, abuse, or threaten others or otherwise violate the rights of another
- infringe the intellectual property of the CAM or a third party
- download or transmit computer viruses or any other software that could damage the property of the CAM or others
- reverse engineer or disassemble any code or software on or from the site
- violate or attempt to violate the security of the website through any unauthorized access, circumvention of encryption or other security tools, exploitation of data or interference with any host, user, or network
- commit fraud
- create a game, lottery or illegal pyramid scheme or take part in such activities
- use the site or any service offered on the site for the purpose of sending spam or bulk promotional emails
- publish or distribute obscene or defamatory material
- publish or distribute any material that incites violence, hatred, or discrimination
- unlawfully collect information about website users, including the collection of email addresses and personal information.
Intellectual property
All elements of our online services, including but not limited to the design, information, text, images, graphics, sound, music, videos, interfaces, architecture, and layout thereof, are the exclusive property of the CAM or its licensors.
Legislation on copyright protects all content of our Services. Modifying elements of the Services that you have downloaded, copied, or printed does not give you any rights to their content.
Using the CAM logo
Artists, artists’ collectives and arts organizations that are required to publicly acknowledge the Conseil’s contribution to their projects and activities can find the CAM logo and specifications for its use at the following address: https://www.artsmontreal.org/en/logos-and-visibility-standards/.
Users agree not to copy, download, share, transmit, modify, display, or publish the CAM logo for any other purpose than to fulfill their obligation to publicly acknowledge the Conseil’s support for their projects and activities. Unless otherwise specified, any other use of the CAM logo is prohibited without the prior written consent of the Conseil des arts de Montréal.
Limitation of liability
You may not hold the CAM liable for any direct or indirect damage suffered in connection with the use of our Services.
Accuracy of information
The CAM strives to provide you with the most complete and accurate information available. However, our Services may contain inaccuracies, omissions, spelling mistakes, typos, or other deficiencies. We may also, without prior notice, change the information posted on our websites, applications, and other Services. CAM Services and all related content are made available to you without any warranty. The CAM is not responsible for any potential errors.
Hyperlinks
Our Services contain hyperlinks to other websites, including social media sites. The CAM makes these hyperlinks available for your convenience. The CAM has no control over the content of these sites and accepts no responsibility for their content or privacy practices.
Availability of our Services
The CAM uses reasonable means to ensure the security and continuity of its Services. However, from time to time, certain factors beyond the CAM’s control could cause temporary service interruptions. You agree not to hold the CAM liable for the consequences of such interruptions.
However, the CAM may modify or make unavailable, temporarily or permanently, part or all of its Services at any time, without notice, and at its sole discretion. The CAM cannot be held liable for any inconvenience or damage caused by a change or by temporary or permanent interruption of its Services.
Operation
The CAM is not responsible for the incompatibility of any software downloaded or copied from its online services, or for any interruption, defect, data processing or transmission delay, or power or system failure.
Legal Framework
The Terms and Conditions and any other legal notices posted on our Services constitute your entire agreement with CAM regarding use of its Services.
Severability
In the event that any of the provisions set out in the site Terms and Conditions are unlawful, void, or unenforceable for any reason, the provision shall be deemed severable from the site Terms and Conditions and shall not affect the validity or enforceability of the remaining provisions.
Applicable laws
Use of our Services is governed by the laws and courts of the province of Quebec and by applicable Canadian laws. Any dispute between you and the CAM, or any other person involved, will be resolved before the Quebec courts located in Montréal.
Legal recourse against the CAM
You waive your rights to any recourse or claim against the CAM arising directly or indirectly from use of our Services. You also undertake to defend the CAM, its staff members, representatives, and agents in any claim, demand, action, or lawsuit brought against it by individuals or groups as a result of your use of our Services.
